Adults with Incapacity (Scotland) Act

Adults with Incapacity (Scotland) Act

Outlining the principles and safeguards in place in Scotland for those who lack capacity

The Adults with Incapacity (Scotland) Act 2000 is the framework for safeguarding the health, welfare and management of finances of adults who lack capacity due to mental disorder/disability or inability to communicate.

It is an Act that supports the implementation of arrangements to give ‘others’ (such as relatives or other appointed people) the authority to act for (or make decisions for) a person who lacks capacity to make decisions for themselves and also sets out the principles which must be followed by everyone who is involved with (or who has the authority to act on behalf of) a person with incapacity.

In this course, we will therefore consider the key elements within this important topic including:

  • Overview of the Act
  • Consent, capacity and decision making
  • Assessment and those requiring help
  • Powers of attorney and guardianship
  • Supporting decision making
  • 5 Key principles

In contrast to classes attended regarding child protection, this e-learning course was more in-depth, accessible, and compulsory engagement required due to test . Attended classes can have a passive attendance quality as there is no test, so that you can see people passing the time on their mobile phones!!

The e-learning course - the flow chart was useful for people like me (A&E junior nurse) as well as the case study. This will influence my practice.
